About Judge Dan O’Brien

The Honorable Dan O'Brien is the probate court's presiding judge of Estates and Trusts.

Before his election to the probate court in 2008, Judge O'Brien was an Oakland County District Court magistrate for 7 years and served for 20 years as a general practitioner focusing on civil, criminal, and probate law.

Before that, he was assistant Oakland County prosecutor, a research attorney for Hon. Myron H. Walls in the Michigan Court of Appeals, and an electrical engineer at Texas Instruments.

Judge O'Brien is a member of the State Bar of Michigan, the Oakland County Bar Association, the Michigan Probate Judges Association, and the Southeast Michigan Probate Judges Association.

The Probate Court

Estates

The Estates division handles matters concerning decedent estates, Will safekeeping, minor guardianships or conservatorships, and adult guardianships or conservatorships for legally incapacitated individuals.

Mental Health

The Mental Health division handles adult guardianships for individuals with developmental disabilities, transport orders for individuals with a mental illness, and mental health commitment hearings.
